Naturely Terms of Use

These terms are an agreement between you and Optivane LLC ("Naturely", "we", "us") about using the Naturely app. By creating an account you agree to them and to our Privacy Policy. If you don't agree, please don't use Naturely.

1. Naturely is in beta

Naturely is an early test version. Features may change or disappear, and things may break. We may reset rankings or challenges while we test. We'll try not to lose your photos, but please keep your own copies; Naturely isn't a backup service.

2. Your account

• You must be at least 16 years old.
• One account per person. Keep your sign-in email or Apple/Google account secure — whoever controls it controls your Naturely account.
• You're responsible for what happens under your account.

3. Your photos stay yours

You keep ownership of the photos and captions you upload.

To run Naturely, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, resize, display and process your photos and captions. That licence lets us:

• show them in the app: the feed, voting, rankings, challenges, your profile and the welcome screen
• send them to our service providers for scoring and safety checks, as described in the Privacy Policy
• make the smaller copies the app needs

The licence ends when you delete the photo or your account. The exceptions are copies other people have already shared outside the app using the share button, and backups that are about to be overwritten.

We won't sell your photos, and we won't use them in advertising without asking you first.

You confirm that every photo you upload was taken by you, and that you have the right to give us this licence. If a photo shows someone recognisable, you also confirm you're entitled to share it.

4. Community rules

Follow the community guidelines. They're in the app and are part of these terms. In short:

• Upload only nature photos, and only ones you took yourself.
• Only real photographs. Normal editing is fine. Composites, AI-generated images and AI-altered images are not.
• Respect wildlife, and don't reveal sensitive locations.
• No harassment, hate, sexual content or violent content.
• Vote honestly. Don't coordinate votes, use automation, or make extra accounts.

There is no tolerance for objectionable content or abusive users. Anyone can report a photo or block a user. Reported photos are hidden while a person reviews them, and we act on reports within 24 hours. We may remove content, limit uploads, remove a photo from rankings, or suspend or close accounts that break these rules. Where we can, we'll tell you why.

5. Scores, critiques and rankings

• The AI score and critique are an automated opinion about a photo. They aren't a professional judgement, and they can be wrong.
• Community rankings come from other people's votes.
• We don't guarantee any particular score, rank or result.
• Scores are never re-run on request.
• Money and ads never affect scores, votes or rankings.
• Challenges are for fun. There are no prizes unless we announce them separately with their own rules.

6. What you can't do

Don't:

• break the law using Naturely
• upload anything that infringes someone else's rights
• try to get around the safety checks or upload limits
• scrape or copy other people's photos out of the app
• interfere with the service, probe it, or reverse-engineer it
• access other people's accounts or data
• use Naturely to send spam

7. Leaving, and ending accounts

• You can delete your account at any time in Settings. This deletes your photos.
• We may suspend or close an account that breaks these terms. We may also end the beta, or the service, for everyone. If we shut Naturely down, we'll try to give you notice so you can save your photos.

8. Disclaimers

Naturely is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't promise it will be uninterrupted, error-free, or that scores or rankings will be accurate.

9. Limitation of liability

To the extent the law allows, we aren't liable for:

• indirect, incidental or consequential losses
• lost data or lost profits

Our total liability to you is capped at the greater of the amount you paid us in the last 12 months and US$100. During the beta, the amount you paid us is zero.

Nothing in these terms limits any liability that can't legally be limited. That includes your rights as a consumer where you live.

10. App stores

If you got Naturely from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google aren't responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

11. Changes to these terms

We may update these terms. If a change is significant, we'll tell you in the app before it takes effect. If you keep using Naturely after that, you accept the new terms.

12. Governing law

These terms are governed by the laws of the State of North Carolina, United States, except where the law where you live gives you protections that can't be waived.
